How much should we really rely on a hair test in Child Arrangement Proceedings?

A recent Family Court case has highlighted the importance of carefully scrutinising drug and alcohol testing evidence. In that case, a parent who had previously struggled with ketamine misuse was accused of continued drug use based on hair strand test results, despite maintaining that they had stopped using the substance and producing negative urine tests. Following further investigation and expert analysis, the court ultimately accepted that the test results may not have told the full story.
The case serves as an important reminder that hair strand testing should be treated with caution and considered alongside all other available evidence, rather than relied upon in isolation.
Why Is Hair Strand Testing Used?
Hair strand testing is based on established scientific principles. As hair grows, traces of substances present in the bloodstream can become incorporated into the hair shaft, allowing laboratories to analyse patterns of drug or alcohol use over time.
Because the tests can provide a picture of substance use over several months, they are often relied upon in family court proceedings where allegations of drug or alcohol misuse are raised.
Is Hair Strand Testing Always Reliable?
Although hair strand testing can be a useful tool, experts increasingly acknowledge that interpreting the results is not always straightforward.
Factors such as hair type, chemical treatments, differences in hair growth rates and even environmental exposure can influence findings. As a result, test results should not automatically be treated as definitive proof of ongoing substance misuse.
In the case in question, the original report itself recognised uncertainty and stated that it could neither confirm nor exclude the parent’s account that they had stopped using ketamine.
Looking Beyond the Test Results
The parent involved in the case admitted to a single instance of ketamine use in February 2024. However, further hair strand testing appeared to suggest more extensive use, raising concerns about their credibility.
An independent expert was instructed to review the findings and consider whether external factors could have affected the results. One possible explanation was that repeated use of hair straighteners may have caused traces of ketamine to migrate along the hair shaft, potentially affecting the interpretation of the test.
The expert accepted that this explanation was scientifically plausible.
When the court considered this evidence alongside negative urine tests, positive parenting assessments and continued engagement with support services, it reached a different conclusion. Ultimately, the court determined that the parent should continue to spend time with their child.
What Does This Mean for Parents?
This case has prompted wider discussion within the family law community about the weight that should be given to hair strand testing and whether additional safeguards are needed when such evidence is relied upon.
The Family Justice Council has reportedly been asked to consider the issue, and further guidance may follow. While hair strand testing remains an important evidential tool, this case serves as a reminder that no single piece of evidence should determine the outcome of a case.
The court’s role is to consider all of the available evidence and make decisions that are in the child’s best interests.
